Realequalism Terms of Service

Welcome to Realequalism. These Terms of Service govern your access to and use of the Realequalism website, products, and services. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Our Services
Realequalism is a print-on-demand e-commerce platform. All products listed on our store are produced on demand by our fulfilment partner, Gelato, and shipped directly to you from the production facility nearest to your delivery address.
Products are created only after an order is placed. As such, all items are custom-made and personalised to your order. This means standard return rights for change of mind do not apply, in accordance with applicable consumer law exceptions for custom-made goods.
2. User Content & Intellectual Property
All designs, artwork, text, and branding displayed on Realequalism products are the intellectual property of Realequalism or its licensors. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.
By placing an order, you confirm that you are not using our services to reproduce or distribute any material that infringes the intellectual property rights of any third party. You are solely responsible for ensuring that any content you upload, request, or reference does not violate applicable laws or the rights of others.
We reserve the right to refuse service, cancel orders, or remove content that we determine, in our sole discretion, to be unlawful, offensive, infringing, or otherwise inappropriate.
3. Prohibited Content
You may not use our services to order products bearing content that is:
- Obscene, pornographic, sexually explicit, or adult in nature.
- Hateful, harassing, defamatory, discriminatory, or threatening.
- Infringing on any third party's copyright, trademark, or other proprietary rights.
- Violating any applicable law or regulation.
- False, misleading, or deceptive.
- Promoting violence, illegal activity, or self-harm.
We reserve the right to screen orders and refuse fulfilment of any item we suspect violates these prohibitions.
4. Order Accuracy
You are responsible for the accuracy of all information provided at checkout, including:
- Product selection (size, colour, style, variant).
- Shipping address (including postcode, country, and contact details).
- Personalisation details (if applicable).
Realequalism and our fulfilment partner are not responsible for errors arising from incorrect information provided by the customer, including undeliverable packages due to incorrect addresses. In such cases, the customer is liable for the cost of a replacement order.
5. Pricing & Payment
All prices are listed in GBP (British Pounds) and include applicable VAT where required. Shipping costs are calculated at checkout based on the delivery destination and selected shipping method.
Payment is processed securely through our third-party payment providers. We do not store your full credit card information. By placing an order, you authorise us to charge the total amount to your selected payment method.
We reserve the right to adjust prices, discontinue products, or correct pricing errors at any time.
6. Fulfilment, Shipping & Delivery
Orders are fulfilled by Gelato, a global print-on-demand network with production partners in over 32 countries. Orders are routed to the facility nearest to your delivery address to minimise shipping times and environmental impact.
Delivery times vary depending on the product type, destination, and local production capacity. Estimated delivery windows are provided at checkout but are not guaranteed. Delays may occur due to high demand, public holidays, customs processing, or circumstances beyond our control.
Once your order is shipped, you will receive tracking information via email. For split orders (where multiple items are produced at different locations), you may receive multiple tracking numbers.
7. Returns, Refunds & Quality Issues
As our products are made to order and personalised, we do not accept returns for change of mind, incorrect sizing, or colour preference.
For quality issues, damaged products, or manufacturing defects, please refer to our Returns & Quality Guarantee policy. Claims must be submitted within 14 days of delivery with clear photographic evidence.
Approved quality claims will result in a complimentary replacement or refund at our discretion. We do not offer cash refunds unless the original payment method is no longer valid.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Realequalism and its fulfilment partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or products.
We are not responsible for:
- Force majeure events (natural disasters, pandemics, strikes, acts of war).
- Delays caused by third-party shipping carriers.
- Losses arising from incorrect information provided by the customer.
- Minor colour variations or print placement tolerances inherent in the printing process.
- Customs duties, taxes, or import fees for international deliveries.
Our total liability for any claim shall not exceed the purchase price of the product in question.
9. Indemnification
You agree to indemnify and hold harmless Realequalism, its owners, officers, employees, and fulfilment partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms of Service.
- Your infringement of any third-party intellectual property rights.
- Your misuse of our products or services.
- Any content you upload or request that violates applicable law.
10. Privacy & Data Protection
We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR and Data Protection Act 2018.
Order and customer data is shared with our fulfilment partner, Gelato, solely for the purpose of producing and delivering your order. Gelato processes this data in accordance with their Data Processing Terms and does not use it for independent marketing purposes.
By using our services, you consent to this data sharing for fulfilment purposes.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after any changes constitutes acceptance of the revised terms.
